Lawsuit against Marineland moves ahead

The lawsuit against Marineland by a former employee is moving forward.

Marineland sued Phil Demers for more than $1.5 million in 2013 on claims of tresspassing and threats to employees.

A year later, the marine mammal trainer countersued citing defamation and abuse of process.

Yesterday, Superior Court  Judge Meredith Donohue ruled in favour of an amended pleading, which is a summary of the plaintiff's claim.

Demer's lawyer told the Niagara Falls Review they are now in a position to move forward.

The newspaper reports the lawyer for Marineland argued  the amendments were prejudicial and unnecessary and would create antipathy toward his client.

The amendment suggests Marineland has used the civil court system to silence its critics
