Man charged with sexual misconduct avoids jail time
A Kelowna man charged with assault, sexual assault, and breaching his bail conditions, was given a 50-day conditional sentence, as well as two years of probation, during his sentencing hearing on Friday afternoon.
39-year-old Armando De Alba was arrested in May of 2017 after he had entered a woman’s house, tried to kiss her repeatedly, and assaulted her.
He was released on bail, and was ordered to not have any contact with the victim, but it was only days until he broke that condition.
De Alba had reached out to the victim numerous times on social media, who told him that she didn’t want to see him.
Later on, De Alba returned to the victim’s residence and assaulted her in a similar manner to the first incident. After the police were called, De Alba was arrested nearby a second time.
De Alba pleaded guilty to his charges, hoping to avoid both a trial, and the victim having to testify.
In addition to his sentence, De Alba was given a firearms ban, and is to have no further contact with the woman he assaulted.
The victim, whose identity is protected under a publication ban, has since moved away from Kelowna.
De Alba has a criminal record going back to 1998, with charges including domestic assault and uttering threats.
