Sunwing sued over fatal boat rental accident

A 47-year old man from Laval has filed a $340,000 lawsuit against Sunwing, after he was sentenced to four years in a Cuban prison following a fatal boating accident.

Toufik Benhamiche was convicted of reckless homicide last summer after he was found responsible for the death of a woman from Ontario at a Cayo Coco resort last July.

Benhamiche's lawyer Julius Grey told CJAD 800 News that their lawsuit alleges the rental company at the resort only gave cursory instructions, assuring him that he would be able to operate the boat.

Twenty metres from the dock, Benhamiche struck another boat, kiling the Ontario tourist.

He has since appealed his conviction and remains in Cuba awaiting a decision by the Supreme Court.

Three employees of the boat rental company were also questioned in the case but none were charged.

Grey said his client is being made a scapegoat.
