Devin Morningstar loses appeal of first-degree murder
New Brunswick's Court of Appeal has turned down Devin Morningstar's appeal of his first-degree murder conviction.
The 19-year-old was convicted of first-degree murder and arson in the death of Baylee Wylie, whose body was found in a burned-out triplex in Moncton in December 2015.
According to the Times & Transcript, Morningstar's notice of appeal said the trial judge did not properly instruct the jury on issues of reasonable doubt, and did not allow them to consider the defence of duress.
Two others were also charged in connection with Wylie's death.
Tyler Noel pleaded guilty to second-degree murder and arson, and will be sentenced in July.
Marissa Shephard is charged with first-degree murder and arson, and is awaiting a trial date.
