Appeal Granted

The family of an Armstrong teen who was killed on Halloween night in 2011 says they are devastated to hear that a new trial has been ordered for the man convicted of first-degree murder in her death.
 A B-C Appeal Court panel has ruled that two of five issues raised by Mathew Foerster's lawyers were enough to require a second trial.
Foerster, who is now in his 30's, was convicted nearly three years ago in the killing of 18-year-old Taylor Van Diest of Armstrong.  Van Diest's uncle Paul Albert says the family feels the system has failed them terribly, and that Foerster is being allowed more rights than the victim had.
