Madonna’s bid to block the sale of personal items – including a letter from the late Tupac Shakur – was dealt another blow on Tuesday.
A 5-0 decision by an appellate court in New York City upheld an April 2018 ruling by Justice Gerald Lebovits that the pop star waited too long to file a lawsuit against an online auction company and her former art consultant Darlene Lutz.
Madonna sued over the sale of items that she said went missing when she moved out of a home in Miami in 2004 but Lebovits dismissed the case because she exceeded the three-year statute of limitation for filing.
Among the 20 items up for auction are a pair of Madonna’s underwear as well as a hairbrush with some of her hair. The Jan. 15, 1995 letter from Shakur – written while he was serving time for sexual assault – informed Madonna that he was ending their relationship over fears his career would be harmed by dating a white woman.
