Mariah Carey Sued Again By Songwriter Over 'All I Want for Christmas Is You'

'Tis the season to sue Mariah Carey over her mega hit, "All I Want for Christmas Is You."

For the second year in a row, songwriter Andy Stone has filed a lawsuit against Carey, claiming she and co-songwriter Walter Afanasieff copied his 1989 song (released under Vince Vance and the Valiants), also titled "All I Want for Christmas Is You," for their 1993 hit, citing "copyright infringement and unjust enrichment."

People reports that in the court documents, Stone argues that his song actually charted on Billboard's Hot Country Singles & Tracks in 1993, the same year Carey's song was released. He believes that Carey took his song's "compositional structure," despite admitting he did not coin the phrase "all I want for Christmas is you."

"Defendants knew or should have known that 'All I Want or Christmas is You' could not be used in a musical work by Defendants without a license and/or songwriting credit, as is customary practice in the music industry," the documents read.

The plaintiff's lawyers acknowledge that Carey and Afanasieff "undoubtedly had access" to Stone's song "given its wide commercial and cultural success."

Stone is asking for a jury trial and is suing for $20 million in damages.

Carey, meanwhile, is preparing to embark on her Merry Christmas One and All! Tour, which starts November 15 in Highland, California. She has two Canadian dates on the tour: Toronto's Scotiabank Arena on November 27, followed by Montreal's Bell Centre on November 29.
